Real Estate Practice Group

We represent financial institutions and investors in the purchase, leasing, disposition and financing of real estate assets including construction, interim and permanent financings and in that context counsel clients in the important area of environmental risk management and allocation. We also regularly advise investment banks and others in the acquisition of packaged debt and other real estate interests such as whole loan, FHA insured mortgages and real estate tax certificates with a view towards securitization of those interests.

With the recent growth of new financing structures, we have been active in representing insurance companies and investment banks in refinancing of real estate mortgages through repurchase agreements and other capital markets vehicles. In conjunction with the efforts of our business finance and bankruptcy practice groups, we also take an active role in the workout and financial restructuring of troubled loans. Such refinancings and restructurings include securing debtor-in-possession financing with debtor real estate assets, restructuring of existing mortgage arrangements and the sale and liquidation of owned real estate.

Leasing of commercial properties, on behalf of owners and tenants is another important aspect of our practice. A particular area of expertise the group has developed is the financing of companies with their primary real estate assets being leasehold interests collateralized by leasehold mortgages and related documentation.
